I cannot believe your insurance company are not giving you top priority. Have they agreed to a loan car?

Apparently there is no loan car because my car is a write off and so is not being repaired.  The insurance company just leaves me in a queue until I get cut off. 

A further development is that my broker Adrian Flux (a forum sponsor) put me onto their claim management company, who in turn put me onto personal injury solicitors.  I have spent time dealing with these people from my sick bed.  Yesterday I received a curt email from the claims management company saying that they and the solicitors could not continue with me because my policy was taken out in September of last year (which they knew from the start).  I may try to see if Adrian Flux can intervene with the car insurance company at least.

I managed to get through to the insurance company o the phone yesterday, so I hope things will ow get moving.

Me too.   I think to be fair to Adrian Flux you need to clarify the situation, as they cannot do so themselves on   individual cases on an open Forum .

I am not an insurance expert. I've never even made a claim.  But the following thoughts may be relevant.

If your main policy is less than a year old  I'd expect it to be valid for the crash.  But did you have the optional legal cover?  Its not automatically part of comprehensive cover.  Some companies include it automatically within their premium  ,but others have it as an option at extra cost.
  The risks  of this ,and some other extras  such as windscreen cover, breakdown insurance etc  is often insured ,not by the main policy insurer, but by separate small specialists underwriters who would bear the cost of legal advice etc.Each gets a portion of your premium to cover their risk.    Thus it may be possible that although the claim goes forward with a valid comprehensive policy  it may not be immediately obvious that these 'extras' are not actually covered on your case  until further into  the claims process .   And of course you cant add them after the crash has already happened.   Maybe someone has been  remiss in not spotting it earlier, or by  their curt response, but even if it had been spotted earlier, you still wouldnt have been covered. Sorry, that horse has already bolted.   

The normal claims process may meet all your needs.  I hope all goes well.  But If you need additional  legal advice regarding  adequate personal injuries compensations etc   you might find  one of the 'no win no fee' personal injury lawyers could help,  but they will take a proportion of the settlement.

I have found'Legal Cover too be a scam and a complete waste of money.
The insurers are employed by the policy holder, not only to pay up but in cases of no fault prangs to fight the offenders insurance company, after all it is in their own interest.
Also a word of warning........
SWMBO was insured by Lloyds Bank. As well as being a Lloyds banking customer all her life. The trauma of all the faffing about and trying to deal with 5* separate companies when her car was T boned and written off at a junction (Other party 100% to blame.) Nearly caused her to have a nervous breakdown. It was far worse than the the sideways severe whip lash she suffered fo the following 2 years.
All this rubbish was caused by the fact that Lloyds Bank are NOT an insurance company. They are merely facilitators. This is the same with all 'OTHER' suppliers of car insurance. They are NOT insurance companies. Buy insurance through them at your peril!
5* companies were:-
Car hire company.
Scrap car removal.
VW dealer (??) to give W.O. value for her Jazz.
Physio for whip lash. (had to pay up front and then add cost to car claim.)
Struggling to get the money out of the underwriter.
I have had 2 claims with Aviva and they are brilliant. No paperwork. You ring them. give them the details of the prang, they tell you to ring for appointment & take (or get collected) your damaged car to one of their owned bodyshops. They supply loan car (if you have included it on your policy). You then get a call to say your car is ready. Go to collect it. Pay excess. drive out!. Simple. no fuss, no stress.

What was the other vehicle that collided with you?  A large SUV or medium car?

It isn't that the legal expenses cover isn't valid.  Rather, the cover is with a different insurer from the one Adrian Flux use now.  (Adrian Flux seem to include legal expenses cover automatically.) 

The solicitors to whom the earlier insurer "feed" their clients (and who make money out of doing the legal work) are a different firm from the one that the current legal insurers use.   Therefore, it seems that I got passed to the "wrong" solicitors, not the one with whom my legal expenses insurers had their "arrangement", but the one with whom the current insurers have an "arrangement".

Clearly, the claims management company and solicitors should have established the position at the start, as they would have know that the insurer changed within the past year.  Instead, they wasted their time and a great deal of mine, at a time when I am in great pain and undergoing physiotherapy in a rehab unit.

I do hope you make a full recovery although the route is going to be difficult and painful. The last thing you need in the circumstances is any hassle with insurance or claims management companies.
Do you know what happened to the other driver and the injuries he suffered?

The other driver seemed to suffer no injuries-at least nothing serious-and went abroad on holiday! 

The police were waiting for his return from holiday to interview him, but said that they intended to charge him with the new offence of causing serious injury by careless driving.

It is somewhat disturbing that you suffered such devastating injuries in a new Honda while those in the Skoda Fabia walked away. The Fabia is not much bigger than the Crosstar so it must give Jazz/Crosstar owners some real concern over the safety rating and crash resistance. Very worrying.
